1. Service Description

Prousto is a platform that allows businesses (restaurants, hotels, bars, gyms, etc.) to collect, view, and analyze content published on social media (Instagram, TikTok…) and review platforms when it is associated with their location.

2. Access to the Service

Users must be at least 18 years old and legally capable of entering into a contract.
They are responsible for the confidentiality of their login credentials and all activity conducted through their account.

3. User Obligations

Users agree to:

  • Comply with all applicable laws (data protection, intellectual property, etc.)
  • Use the service only for lawful purposes
  • Not extract, divert, or monitor third-party accounts without authorization
  • Respect the rights of individuals and third-party platforms
  • Not disrupt the functioning of the service

4. Subscriptions and Payment

  • Subscriptions are paid according to the prices listed on the site, excluding taxes.
  • Payment is securely processed via Stripe.
  • Subscriptions are automatically renewed (monthly or yearly).
  • Prousto may offer a free trial (1 to 7 days). At the end of the trial, the subscription becomes paid unless canceled beforehand.

5. Termination

  • Users can cancel their subscription at any time from their account.
  • Any period already started remains payable and is non-refundable.
  • Prousto may suspend or delete an account in case of non-compliance with these terms.

6. Limitation of Liability

  • The service is provided "as is", without guarantee of availability or accuracy of data from social media.
  • Prousto is not liable for indirect damages, data loss, or service interruptions.

7. Intellectual Property

All content on the site and platform (texts, logos, images, code) is the property of Prousto.
Any reproduction or distribution is prohibited without prior written authorization.

8. Personal Data

  • Data controller: Prousto — Romain Moyne, hello@prousto.com
  • Data collected: name, email, account information, billing data (Stripe), public social media content associated with establishments, usage logs
  • Purpose: provide the service, billing, analyze and improve, support, security, transactional emails
  • Rights: access, rectification, deletion, objection, portability (requests via hello@prousto.com)
  • Transfers outside the EU: some subcontractors (Meta, TikTok) may process data outside the EU, with GDPR-compliant safeguards

9. Changes to Terms

Prousto may modify these terms at any time.
Continuing to use the service constitutes acceptance of the updated terms.

10. Governing Law and Jurisdiction

These terms are governed by French law.
Any dispute falls under the jurisdiction of the competent courts.
